Collection and Storage of Personal Data, as well as the Nature, Purpose, and Use Thereof

If you enter into a business relationship with us, we collect the following information: salutation, first name, last name, date of birth, a valid email address, address, telephone number (landline and/or mobile), bank details (for direct debit procedures) and customer number.

This data is collected to identify you as our customer; to check your creditworthiness; for correspondence with you; for invoicing; to be able to deliver to you; to assert any claims against you (debt collection); for direct debit procedures for bank collection; to carry out the contractual relationship.

Data processing is carried out at your request and is necessary for the appropriate processing of the business relationship and for the mutual fulfillment of obligations arising from the contractual relationship, in accordance with Art. 6 (1) sentence 1 lit. b GDPR.

Direct marketing and market research based on Art. 6 (1) lit. f GDPR may only take place if this is necessary to protect the legitimate interests of the supplier or third parties, and if the interests or fundamental rights and freedoms of the data subject, which require the protection of personal data, do not override them.

If you have given consent to the processing of personal data for advertising, we use personal data on the basis of Art. 6 (1) lit. a GDPR. A customer may revoke consent for advertising at any time in accordance with Art. 7 (3) GDPR by sending an email to datenschutz@jmp-germany.de.

The personal data collected by us for the business relationship will be stored until the expiry of the statutory retention period and then deleted, unless we are obliged to a longer storage period due to tax and commercial law retention and documentation obligations (from HGB, StGB or AO) according to Article 6 (1) sentence 1 lit. c GDPR or you have consented to further storage according to Art. 6 (1) sentence 1 lit. a GDPR.

Disclosure of Data to Third Parties

Your personal data will not be transferred to third parties for purposes other than those listed below: We pass on your personal data, among others, to third parties acting on our behalf, or to commissioned data processors. These are also located outside the Federal Republic of Germany, but within the European Union; the EU General Data Protection Regulation applies there, and the level of data protection is considered secure. If this is necessary for the processing of business relationships in accordance with Art. 6 (1) sentence 1 lit. b GDPR, your personal data will be passed on to third parties. This also applies if this is necessary for the enforcement of claims (e.g. debt collection) and is done in accordance with Art. 6 (1) sentence 1 lit. b GDPR or Art. 6 (1) lit. f GDPR. Your data will also be passed on if we are legally obliged to do so.

In addition, we will disclose your data if you have given your explicit consent to do so in accordance with Art. 6 (1) sentence 1 lit. a GDPR; the disclosure is necessary for processing in accordance with Art. 6 (1) sentence 1 lit. f GDPR and a balancing of interests shows that you do not have an overriding legitimate interest in the non-disclosure of your data; this is legally permissible and necessary for the processing of contractual relationships with you in accordance with Art. 6 (1) sentence 1 lit. b GDPR.

Data Subject Rights/Right to Object
You have the following rights:

  • Right to information about your data stored by us and its processing according to Art. 15 GDPR

  • Right to rectification of inaccurate personal data according to Art. 16 GDPR

  • Right to erasure of your data stored by us according to Art. 17 GDPR

  • Right to restriction of processing if we are not yet allowed to delete your data due to legal obligations according to Art. 18 GDPR

  • Right to notification according to Art. 19 GDPR

  • Right to data portability, provided you have consented to data processing or a contractual relationship exists according to Art. 20 GDPR

  • Right to object according to Art. 21 GDPR

  • Right to withdraw given consents according to Art. 7 (3) GDPR

  • Right to lodge a complaint with the supervisory authority according to Art. 77 GDPR

If your personal data is processed on the basis of legitimate interests pursuant to Art. 6 (1) sentence 1 lit. f GDPR, you have the right, pursuant to Art. 21 GDPR, to object to the processing of your personal data, provided there are grounds relating to your particular situation or the objection is directed against direct marketing. In the latter case, you have a general right to object, which will be implemented by us without specifying a particular situation.
